Licences & Legal Requirements

The registrations and licences an Indian gaming cafe typically needs — business registration, GST, trade licence, cyber cafe rules, FSSAI, music and fire safety.

Gaming cafes in India sit across several rulebooks: shops and establishments, taxation, food, public entertainment and, in many states, cyber cafe rules. Requirements differ by state and municipality, so treat this as a checklist to verify locally with your municipal office and a chartered accountant — not as legal advice.

1. Business registration

Choose a structure before anything else, because bank accounts, GST and rent agreements follow from it:

  • Proprietorship — simplest, suitable for a single small venue
  • LLP — useful when there are partners
  • Private limited — the usual choice if you plan multiple branches or outside investment

2. Shops and Establishments registration

Registration with the state labour department under the Shops and Establishments Act covers working hours, weekly off and employment records. It is usually required within a set period of opening.

3. GST registration

If your turnover crosses the applicable threshold, GST registration is mandatory, and it is often practical to register from day one:

  • Session charges, food and merchandise can attract different rates
  • Registered vendors expect a GSTIN on purchases
  • Corporate and event customers usually ask for a GST invoice

4. Municipal trade licence

Most municipal corporations require a trade licence for a commercial entertainment establishment. Renewal is typically annual.

5. Cyber cafe / police registration

Many states apply cyber cafe rules to venues that provide public internet access. Where those apply, obligations commonly include:

  • Registering the establishment with the designated authority
  • Recording customer identity details before providing access
  • Retaining logs of usage for a prescribed period
  • Displaying prescribed notices on the premises

Confirm what your state and local police jurisdiction actually require, since enforcement and detail vary. Capturing customer name, phone and ID reference at check-in — which cafe software can do automatically — makes compliance far easier than a paper register.

6. FSSAI registration

If you serve, prepare or even resell packaged food and beverages, FSSAI registration or a licence is required depending on scale and turnover.

7. Music and public performance licences

Playing recorded music on the floor, or streaming content publicly, generally requires appropriate public performance licensing from the relevant rights organisations.

8. Fire safety and building clearances

Depending on floor area, occupancy and which floor you are on, you may need a fire NOC and to comply with exit, extinguisher and signage requirements. Local fire departments are strict about this in mall and upper-floor locations.

9. Game and software licensing

Use legitimately licensed operating systems and games. Commercial use of consumer licences is a real risk, and one that surfaces at the worst possible moment. Ask distributors specifically about commercial or cafe licensing.

10. Employment basics

  • Written appointment terms
  • Statutory contributions where applicable
  • A basic record of shifts and attendance
